IMPORTANT NOTICE: These Terms govern the use of a digital collectibles platform operating as an NFT seller with optional promotional giveaways. The Protocol does not offer gambling, lotteries, betting, investment products, or financial services of any kind.

BY CONNECTING A WALLET OR INTERACTING WITH THE SMART CONTRACTS, YOU CONFIRM THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO THESE TERMS.

2. Nature of the Product

Product-First Sale: The Fos Digital Collectible is a standalone digital art and utility product. The User's payment is made solely in exchange for the NFT itself.

No Financial Purpose: The NFT is not offered or sold as an investment, financial instrument, security, or store of value. No purchase is made with an expectation of profit.

3. Promotional Giveaways (Ancillary Feature)

• Any reward, giveaway, or benefit is strictly ancillary, optional, and promotional.
• No User is guaranteed to receive any reward or allocation.
• The User acknowledges that they would purchase the NFT regardless of any giveaway.

4. No Gambling, Lottery, or Betting

The Protocol does not involve:

• Wagering, staking, or betting
• Lotteries, raffles, or games of chance
• Loss-for-gain structures

The purchase price is paid solely for the NFT.

5. Non-Custodial Architecture

• The Protocol is non-custodial. The Fos Team does not control, store, or access User private keys or assets.
• All transactions are executed by autonomous smart contracts. The Fos Team cannot reverse, modify, or cancel blockchain transactions.

6. Fees, Gas, and Finality

• Blockchain Finality: Transactions are irreversible. All NFT sales are final. No refunds are possible.
• Gas Fees: Users are solely responsible for all blockchain gas fees.

⚠️ Green Eye Warning: The 500th transaction of any cycle triggers complex contract execution, resulting in ~18x standard gas costs. By transacting, you voluntarily accept this risk.

7. Affiliate / Referral Program

• Participation is optional.
• Referral benefits are promotional incentives, not income or employment.
• Users are solely responsible for any applicable tax obligations.

8. Geographic Restrictions

Access is expressly prohibited for residents of:

• 🇺🇸 United States of America (and territories)
• 🇨🇦 Canada
• 🇬🇧 United Kingdom
• 🇪🇺 European Economic Area
• 🇨🇳 People's Republic of China
• Sanctioned jurisdictions (OFAC, UN, EU)

🚫 Use of VPNs or proxies to circumvent restrictions is strictly prohibited and deemed fraudulent.

9. Disclaimers and Risk Disclosure

• The Protocol is provided "AS IS" and "AS AVAILABLE" without warranties.
• Users acknowledge the risks of blockchain technology, including bugs, exploits, and network congestion.

10. Limitation of Liability

To the maximum extent permitted by law, the Fos Team's total liability shall not exceed the amount paid by the User for a single NFT.

11. Dispute Resolution

• Binding Arbitration: Any dispute shall be resolved by binding arbitration.
• Seat: Saint Vincent and the Grenadines.
• Governing Law: Laws of Saint Vincent and the Grenadines.
• No Class Actions: Users waive any right to class, collective, or representative actions.

12. Refund & Claim Policy

ALL SALES ARE FINAL. Due to the immutable nature of blockchain transactions, payments cannot be reversed.

• Waiver of Withdrawal Rights: By initiating a Mint transaction, you waive your right of withdrawal under applicable consumer protection laws.
• Gas Fees: Non-refundable, even if transactions fail.
• Cycle Rewards: Pushed automatically.
• Campaign Rewards: Must be claimed manually.

13. Entire Agreement

These Terms constitute the entire agreement between the User and the Fos Team. In case of conflict, these Terms prevail over any whitepaper, marketing material, or documentation.
